Since modern medicine is based substantially in clinical medical research, the flaws and ethical problems that arise in this research as it is conceived and practiced in the United States are likely to be reflected to some extent in current medicine and its practice. This paper explores some of the ways in which clinical research has suffered from an androcentric focus in its choice and definition of problems studied, approaches and methods used in design and interpretation of experiments, and theories (...) and conclusions drawn from the research. Some examples of re-visioned research hint at solutions to the ethical dilemmas created by this biased focus; an increased number of feminists involved in clinical research may provide avenues for additional changes that would lead to improved health care for all. The work of feminists in science may seem less voluminous and less theoretical than the feminist scholarship in some humanities and social science disciplines. However, the recent burst of scholarship on women and science allows categorization of feminist work into six distinct but related categories: 1) teaching and curriculum transformation in science, 2) history of women in science, 3) current status of women in science, 4) feminist critique of science, 5) feminine science, 6) feminist theory of science. Flaws, biases, and ethical problems surrounding research and diagnosis may lead to inappropriate or inequitable treatments that exacerbate or fail to improve the misery that some individuals face due to their psychiatric conditions. Possible androcentric biases in the choice and definition of categories for diagnosis available in DSM-III-R may in turn influence the approaches of therapists to clients, particularly male therapists towards female clients. Androcentric bias in diagnosis, which may also be reflected in the values of the psychiatrist, may lead (...) to treatment regimens designed to make clients fit into roles, positions, and norms prescribed by a culture reflecting patriarchal values. Ted Shotter's founding of the London Medical Group 50 years ago in 1963 had several far reaching implications for medical ethics, as other papers in this issue indicate. Most significant for the joint authors of this short paper was his founding of the quarterly Journal of Medical Ethics in 1975, with Alastair Campbell as its first editor-in-chief. In 1980 Raanan Gillon began his 20-year editorship . Gillon was succeeded in 2001 by Julian Savulescu, followed by John Harris and Soren Holm (...) in 2004, with Julian Savulescu starting his second and current term in 2011. In 2000 an additional special edition of the JME, Medical Humanities , was published, under the founding joint editorship of Martyn Evans and David Greaves. In 2003 Jane Macnaughton succeeded David Greaves as joint editor. Deborah Kirklin, under whose auspices MH became an independent journal, took over in 2008, and she was succeeded in 2013 by Sue Eckstein. This short paper offers reminiscences and reflections from the two journals’ various editors.From the start the JME was committed to clearly expressed reasoned discussion of ethical issues arising from or related to medical practice and research. In particular, both Edward Shotter and Alastair Campbell, each a cleric , were at pains to make clear that the JME was not a religious journal and that it had no sort of partisan axe to grind.Campbell's appointment as founding editor was something of a surprise, as the original intention had been to appoint a medical doctor, who could be expected to know medical practice from the inside. ABSTRACT:Analytic philosophers have criticized A. N. Whitehead's metaphysics for being obscure, yet several such philosophers have espoused positions in metaphysics and philosophy of mind that were advanced by Whitehead in the 1920s. In this paper, we evaluate the merits and demerits of these criticisms by Bertrand Russell, W. V. Quine, Karl Popper, and others and then demonstrate the affinities and contrasts in the positions advanced by Galen Strawson, David Chalmers, Thomas Nagel, and Whitehead regarding so-called ‘analytic panexperientialism’.

According to theological consensus at least from the thirteenth century, at the End of Times our body will be resurrected and reunited with our soul. The resurrected body, although numerically identical to our present one, will be quite different: it will possess clarity, agility, subtility, and the inability to suffer. It is the last of these characteristics that will be of most concern in the present article. There are two reasons why impassibility presents a problem in the medieval framework. The (...) first has to do with how to characterize impassibility more precisely; the second arises because at first it may seem that impassibility is not metaphysically possible at all. The article will look at three attempts to tackle these problems: those of Thomas Aquinas, Durand of St.-Pourçain, and Peter of Palude. As the article aims to show, looking at how causal powers work on the New Earth may shed some light on how medieval thinkers thought they worked on the present one. (shrink)

Ruggiu gives us here a careful and extended account of Aristotle's view of time with special attention to the necessary connections that obtain between time and consciousness, and time and beilag. Ruggiu is also interested in saying something about the origins of later Western conceptions of time and what he calls the nihilistic tendency which runs through them. The reader who (wishing to follow Ruggiu in this 690 page enterprise) begins by trying to get a sense of the architectonic of the essay, is immediately advised to skip E. Severino's somewhat misleading preface. In his own very useful Introduction, Ruggiu rightly notes that Aristotle's review of the aporia in the notion of time found that his predecessors had tended to assimilate (or reduce) time to non-being. But Ruggiu neglects to emphasize something that would have been very helpful at this stage, and which is altogether required, for the understanding of Aristotle's view of time. This is, that Aristotle himself assimilates time, not to non-being but to change and motion. It is also fundamental to Aristotle's philosophy of time, just as it is to his philosophy as a whole, that it acknowledges the primacy of change in the realm of the conditional. Let it be emphasized, then, that generation or change in Aristotle are not from nothing into something, or from something into nothing but from one thing into another. Ruggiu is trying to recover the sense of being in Aristotle which transcends the oppositions between idealism and naturalism, subjectivism and objectivism, and which is the matrix of Aristotle's sense of, and doctrine about, time. He finds that from Plotinos to the present, the prevailing interpretation of Aristotle's conception of time has been a spatial one in which, for instance, temporal succession has been reduced to spatial co-existence. Plotinos, of course, accepted the distinction found in Aristotle between the eternal sort of being which is outside of time and the being which is in time. But in trying to deduce temporal being from eternal being Plotinos is found guilty, by Ruggiu, both of equivocating between radically opposed senses of being and of developing his notion of time on the basis of the denial of time (quite like some modern mathematical philosophers of physics). Others have been equally mistaken in approaching Aristotle with the belief that consciousness is the basis of time. But the substrate of time, in Aristotle, is change, not conscious being. According to Ruggiu time in Aristotle is more than just a mode of being whose essence consists in succes- I 12 HISTORY OF PHILOSOPHY sion, for the reason that time conditions the very way in which we conceptualize being. The relations between being, time, and consciousness are, so to say, intrafoundational. Existing things or processes can, of course, be thought of as not existing; so, there is a sense or mode (namely, possibility) in Aristotle in which things disappear. In this brief, we argue that there is a diversity of ways in which humans (Homo sapiens) are ‘persons’ and there are no non-arbitrary conceptions of ‘personhood’ that can include all humans and exclude all nonhuman animals. To do so we describe and assess the four most prominent conceptions of ‘personhood’ that can be found in the rulings concerning Kiko and Tommy, with particular focus on the most recent decision, Nonhuman Rights Project, Inc v Lavery.

We use variation in corruption convictions across judicial districts in the US to examine the relationship between political corruption and risk-taking of public firms. Firms headquartered in regions with high levels of political corruption have lower total risk and lower idiosyncratic risk on average. Further analysis shows that corruption tends to encourage firms to pursue risk-decreasing investments, lower the riskiness of their operations, and decrease asset liquidity. While managerial ownership is intended to align the interests of managers and shareholders, the (...) presence of corruption appears to encourage undiversified managers to decrease risk-taking. Our evidence is consistent with agency theory and the asset-shielding argument that political corruption discourages managers from taking risks that expose firms to expropriation by politicians, resulting in suboptimal corporate policies. In this paper, I attempt to synthesize the two most influential contemporary ethical approaches that appeal to moral intuitions, viz., Rawlsian reflective equilibrium and Audi’s moderate intuitionism. This paper has two parts. First, building upon the work of Audi and Gaut, I provide a more detailed and nuanced account of how these two approaches are compatible. Second, I show how this novel synthesis can both (1) fully address the main objections to reflective equilibrium, viz., that it provides neither necessary nor (...) sufficient conditions for the justification of our moral beliefs and (2) help ethical intuitionism to deal with the fundamental problem of peer disagreement over our basic moral intuitions. In doing so, I sketch out a novel and attractive diachronic way of thinking about peer disagreement more generally. (shrink)

George Du Maurier’s best-selling novel, Trilby (1894), is as important because of its defiance of social and cultural norms as it is for its apparent compliance with them. Trilby is a fiction that, like its eponymous heroine, attempts to negotiate the perilously fine line between the highbrow and the lowbrow, or to put it another way, between fine art and political commentary on one side, and pornography and sensationalism on the other. This article examines the way that Du Maurier engages (...) his readership in this textual tease – his seduction of the reader – by suggesting the possibility of a peep show where everything that Victorian respectability abhors may be on display, and then his narratological dressing of the text, to ensure that where there is sexual non-conformity there is also moralism, and where there is social confrontation there is also historical distance. Understanding the textual appeal of Trilby as a character, the artist’s model who enchanted the fin-de-siècle reading public, is essential to appreciating how the discourses of pornography and fine art interact and have consequently evolved. This article therefore examines why Trilby succeeded with the Victorians where other, similarly sexually active heroines – such as Thomas Hardy’s Sue Bridehead – failed. Trilby the novel and Trilby the woman are both broken down by their author into manageable parts, a pornographic fetishistic technique that simultaneously eroticises, and makes more palatable, the textual and the physical bodies. This case note considers the Court of Appeal decision in Royal Bank of Scotland v. Etridge (No. 2) and other appeals [1998] 4 All E.R. 705. It concerns the familiar scenario of a wife jointly mortgaging (or providing a guarantee for a mortgage of) the family home in order to secure financial support for a business run by her husband. The House of Lords decision in Barclays Bank v O'Brien [1994] A.C. 180 has given rise to a range of litigation (...) in this area, and the spotlight has now moved from the banks to an examination of the quality of advice given by solicitors. The banks have heeded the warnings in O'Brien and now insist that wives are told to obtain independent legal advice. It will be seen that, following Etridge, if the bank tells the solicitor to give the wife legal advice upon undertaking the transaction, that will be sufficient to protect the bank, notwithstanding that the advice was either inadequate or even not actually given. The onus to ensure that proper advice is given is shifted squarely on to the solicitor. The note concludes that the decision is indicative of the shift of judicial opinion against wives seeking to avoid charges over matrimonial homes and in favour of banks. (shrink)

Armour Pharmaceutical Co. ), held that the state's Blood Shield Act does not protect pharmaceutical companies that produce blood-derived products from product liability suits based on injuries attributable to tainted blood supplies. Blood shield statutes help to guarantee adequate blood supplies by limiting the liability of blood banks. This holding limits the defenses available to pharmaceutical companies sued under product liability theory.The defendant, Armour Pharmaceutical, produces and sells clotting factor agents, which (...) are derived through plasmapheresis. Plasmapheresis is a costly and complex donation process through which the plasma and red blood cells of a donor's blood are separated. After separation, the process returns the red blood cells to the donor but retains the plasma. (shrink)

The RIAA v. Verizon case offers an opportunity to analyze the scope of an Internet service provider’s responsibility to help deter copyright infringement. In this case, the RIAA served Verizon with a subpoena requesting the identity of two users who were making available copyrighted recordings for downloading on peer‐to‐peer networks. The main axis of discussion is whether or not Verizon has a moral obligation to reveal the names of these individuals. Should Verizon cooperate with the RIAA or should it seek (...) to shield the identity of these users in order to protect their anonymity and privacy? A secondary theme concerns Verizon’s prospective responsibility to curtail infringement. We will argue that Verizon and other ISPs have a limited obligation to assist copyright holders by disclosing the identity of infringers, but we contend that any prospective responsibility is constrained by law and technological capability. In Filartiga v. Pena-Irala (1980), the Second Circuit Court of Appeals ruled that victims of human rights violations could sue their oppressors civilly in US courts under an eighteenth century law now called the Alien Tort Claims Act (ATCA). Controversy raged over the Filartiga decision and the proper interpretation of the ATCA for 24 years. Then in Sosa v. Alvarez-Machain (2004), the Supreme Court issued its first ATCA decision. This essay analyzes the effect of the Sosa decision on the development (...) of human rights law in US courts. I find that while the federal judiciary is responding to some of the Supreme Court’s directives, lower courts still retain a great deal of discretion in handling ATCA cases. (shrink)

ERISA plan fiduciary clearly authorized to do so.In 1991, appellants William and Judith Moore purchased an ERISA health insurance policy from Blue Cross Blue Shield of the National Capital Area and its wholly-owned subsidiary CapitalCare. Blue Cross/Blue Shield of Massachusetts, Inc., the U.S. Court of Appeals for the First Circuit held that defendant Blue Cross/Blue Shield's peer review practices satisfied the immunity standard for professional review actions according to the Health Care Quality Improvement Act, and the First Circuit affirmed the U.S. District Court for the District of Massachusetts's grant of summary judgment in favor of the defendant.After Blue Cross/Blue Shield merged with Bay State Health Care, Blue Cross began to offer “Bay (...) State Health Care” to former Bay State subscribers. Blue Cross denied the plaintiff, Dr. Kunwar Singh, participation in the Bay State Healthcare Network due to poor utilization review. In Campbell Soup Co. v. Allstate Insurance Co. ), the United States District Court for the Western District of Michigan, Southern Division, held that a health plan's coordination of benefits clause, covered under the Employee Retirement Income Security Act, does not preempt a similar no-fault automobile insurance clause in the absence of irreconcilable conflict. The court found that ERISA's policy of shielding plans from unanticipated claims could only be furthered when the plan had expressly disavowed such claims. Because the ERISA (...) plan in this case did not specifically subordinate itself to the no-fault policy, the district court found that the no-fault COB clause controlled. However, to escape this ruling, ERISA plans need only redraft their COB clauses specifically to disclaim liability in case of conflict with provisions of no-fault insurance policies. Second, drawing on his Reconstructing Sociology, his take on the current state of American sociology. One of the most striking innovations in Aristotle’s philosophical writing is also one of its most characteristic features. That feature is Aristotle’s idea that terms central to philosophy, including ‘cause’ [aition], ‘good’, and even the verb ‘to be’, are, as he likes to put it, “said in many ways.” To be sure, philosophers before Aristotle give some evidence of having recognized the phenomenon of being said in many ways. Plato, in particular, suggests that things in this world that we call (...) “just” are only namesakes of the Just Itself. But, beyond that, homonymy seems to have been, even for Plato, no more than a source of ambiguity for wordplay. Aristotle is apparently the first philosopher to propose a taxonomy of homonymy and to view the identification and analysis of homonymies as a genuinely philosophical project. (shrink)

Accomunato ai Milesi per aver posto l’acqua come principio di tutte le cose, è stato considerato anche un pitagorico per aver affermato l’importanza del gioco dei contrari nel nascere e nell’evolversi delle cose. In realtà, queste caratterizzazioni si dimostrano piuttosto generiche, e l’appartenenza a questa o a quella scuola non dà ragione della specificità (...) della sua posizione nell’ambiente culturale mediterraneo e magno-greco, specificità ben rinvenibile anche nella scarsezza delle testimonianze. Più che l’acqua, per Ippone, ammesso che abbia voluto stabilire un’arché di tutte le cose, è l’umido a giocare un ruolo fondamentale nell’essere e nel divenire delle cose. In questo articolo si tenta anche di tracciare un profilo della storia dell’umido, dai Milesi a Eraclito, ad Alcmeone, a Diogene di Apollonia, fino a Democrito. E si vuole inoltre sottolineare come esso rientri anche nel campo specifico delle sue riflessioni, incentrate soprattutto nel campo biologico ed embriologico, riflessioni sempre obbedienti, più che a teorie generali, all’osservazione dell’esperienza concreta. The philosophical literature on personal relationships is focused on dyads: close relationships between just two people. This paper aims to characterise the value of looser and larger relational networks, particularly from the perspective of liberal political theory. We focus on relational networks' value vis-a-vis the important good of felt security. We begin by characterising felt security and analysing how felt security is produced within dyads. We highlight the ambivalent nature of dyadic relationships as a source of felt security. We then (...) theorise relational networks, explaining how they too can provide felt security. We explore three unappreciated benefits that arise when felt security is garnered from a network, rather than from a dyad. These benefits take liberal political theory as their starting point. We close by considering the implications - for both individual action and institutional design - of using relational networks as a source of felt security. (shrink)

The U.S. Court of Appeals for the Third Circuit held, in Brader v. Allegheny General Hospital, 167 E3d 832, that the Health Care Quality Improvement Act, 42 U.S.C. §§ 11101-11152, shields a Pennsylvania hospital from a surgeon's claims of contract violations.The plaintiff, Alan Brader, M.D., joined Allegheny General Hospital's provisional medical staff in July 1988. During the next two years, he performed several abdominal aortic aneurysm repairs and various other operations. Several of Brader's patients sustained serious injuries or died (...) during surgery from complications. In 1989, Brader's supervisors, Drs. Daniel Diamond and George Magovern, met to discuss their dissatisfaction with Brader's behavior, his departures from hospital protocol, as well as his disruptive presence in the hospital. From 1989 to 1990, Brader continued to perform surgical procedures on incoming patients, and he continued to violate hospital notification protocol and lost a patient during surgery. In spring 1990, the Quality Assurance Department compiled data on AAA procedures for the hospital's physicians. (shrink)

Chinese kindergartens’ over 110 years of adaptation of foreign models is a vivid example of how globalization comes into direct contact with Chinese culture and creates cultural hybridities. Learning Stories as a narrative assessment tool to children’s development from New Zealand, has swept China with the endorsement from the professional organizations and local authorities, especially attracting many followers in Beijing. Based on a two-year participatory action research in Beijing, the article examines Learning Stories as policy borrowing, redesigned as an innovative (...) reflection tool for professional learning community which results from processes of mutual influence between the global and the local. The article highlights the importance of culture and context in considering professional development and the ‘fluid’ and dynamic nature of ‘glocalization’ working towards integration of globalization and localization. Canto XX (Accorinti) – in quello che si annuncia come un progetto di edizione critica commentata di tutti canti del poema sacro nonniano: progetto certamente ambizioso ma indispensabile per fare luce piena su un momento fondamentale dell'epica tardoantica. Diversamente dalla poesia centonaria, Nonno, pur seguendo dappresso la Vorlage evangelica, volle fare opera in qualche misura originale e ci riuscì, pur con uno stile che non si potrebbe immaginare più contrastante rispetto alla austera sobrietà del dettato giovanneo. Il volume di Agosti, sostenuto da una ricchissima e pressocché completa bibliografia, si apre con una Introduzione assai ampia e decisamente pregevole per la capacità dimostrata dallo studioso di inquadrare il poema nonniano nell'ambito vasto dell'epica tardoantica non solo greca ma anche latina: da questo punto di vista illuminanti appaiono i raffronti con Giovenco, Aratore, Claudiano, Prudenzio, Commodiano, oltre che, naturalmente, con Gregorio Nazianzeno, Eudocia e gli Homerocentones. Convinto che il Nonno parafraste sia il medesimo autore delle Dionisiache, Agosti ritiene decisamente superata la tesi contraria, e intelligentemente si limita a rilevare la straordinaria affinità fra i due poemi non solo a livello stilistico, linguistico e metrico, ma anche – aspetto forse ancora più sorprendente – sotto il profilo concettuale: «Vi sono elementi di chiaro influsso cristiano nelle D. e d'altra parte la figura di Cristo tende ad assumere alcuni tratti bacchici nella P.» (p. 46). Una tesi, questa, che viene corroborata con numerosi raffronti puntuali nelle dense note di commento. Essendo gran parte del Canto Quinto, corrispondente al quinto capitolo del vangelo giovanneo, dedicato al miracolo del paralitico guarito nella piscina di Bethesda, viene affrontato il problema dello spazio dedicato ai miracoli di guarigione nel mondo pagano e cristiano del V secolo, in particolare nell'ambiente egizio dove Nonno visse e operò (ma molto cauto si mostra, a mio avviso saggiamente, l'Autore nei confronti di identificazioni troppo incerte, come quella che vorrebbe Nonno vescovo di Edessa). Il lettore deduce dalle sue considerazioni come nulla di sorprendente o di aberrante l'uomo tardoantico potesse scorgere nel racconto di Giovanni, che anzi non discorda da analoghe imprese attribuite ad Asclepio, il dio guaritore ϰατεξοχήν, ma anche a taumaturghi come Apollonio di Tiana: si trattava, se mai, di una sorta di concorrenza fra Cristo e i suoi omologhi e rivali pagani. Allo stesso modo, Agosti pensa che il pubblico della Parafrasi e quello delle Dionisiache fosse in sostanza il medesimo, forse con una percentuale cristiana maggiore nel primo caso e minore nel secondo. Ovviamente si rimane nel campo delle ipotesi, ma certo il sincretismo del tempo poteva forse spingersi tanto avanti da giustificare simile osmosi, anche se appare lecito dubitare che cristiani convinti giungessero a tollerare l'incredibile ampiezza del poema a gloria di Dioniso, e, viceversa, che a un pubblico pagano potesse veramente interessare il vangelo di Giovanni – di cui per altro Agosti segnala qualche risonanza in ambiente neoplatonico. Meritorie appaiono anche le osservazioni sul retroterra esegetico del poema sacro, «più vicino all'esegesi che alla parafrasi stricto sensu» (p. 111), con particolare riferimento al commento giovanneo di Cirillo d'Alessandria: una consonanza del resto già osservata da altri studiosi della Parafrasi. Nelle note l'Autore cita numerosi passi da Cirillo, non nascondendosi comunque la notevole libertà con cui Nonno – il cui intento primario non dovette certo essere teologico – se ne servì. Non meno interessanti le considerazioni su alcuni punti di contatto con la liturgia, tema di cui Agosti segnala la non secondaria importanza per una valutazione corretta e completa dell'epica cristiana.
